The 2026 U.S. Farm Bill introduces a tightened definition of “intoxicating hemp” that will effectively ban most delta‑9 THC and hemp‑derived products currently on the market. Under the new rule, any product containing more than 0.4 milligrams of THC per container is prohibited, a threshold far lower than the 0.3 percent‑by‑weight limit that Wisconsin businesses have relied on since the 2018 Farm Bill.

What the rule changes

Previously, Wisconsin hemp dispensaries could sell items such as gummies, tinctures and vape cartridges with up to 0.3 % delta‑9 THC by weight, exploiting a loophole that left many novel cannabinoids—delta‑8, THCP, delta‑10—unregulated. The forthcoming regulation replaces that weight‑based cap with an absolute milligram limit per container. For a typical 1‑gram edible, 0.4 mg THC equals just 0.04 % concentration, meaning most existing products exceed the allowance and will be illegal to sell.

The rule takes effect on November 12, 2026, giving businesses roughly one year to adjust their inventories, seek reformulation, or cease operations.

Economic and employment impact in Wisconsin

Wisconsin Governor Tony Evers estimates that the federal change could jeopardize about 3,500 jobs and slice roughly $700 million from the state’s economic output. The state currently hosts 470 federally licensed hemp growers, many of whom supply raw material to processors and retailers that now face an uncertain future.

Industry observers note that the abrupt shift may push some operators toward the illicit market or force them to pivot to non‑intoxicating hemp products such as fiber, grain, or cannabidiol (CBD) isolates that remain compliant with the new THC ceiling.
