ONE HEMP Welcomes Bipartisan Lawful Hemp Protection Act

On July 24, 2026, the national coalition ONE HEMP announced its support for the newly introduced Lawful Hemp Protection Act, a bipartisan bill sponsored by Representatives Andy Barr (R‑KY) and Angie Craig (D‑MN). The legislation seeks to create a federally regulated framework for hemp products that balances consumer safety with continued access to therapeutic cannabinoids.

Key Provisions of the Bill

The proposal would establish several nationwide standards, including:

  • A 1% THC by dry weight ceiling for hemp‑derived products.
  • Minimum age restrictions of 21 years for purchase.
  • Mandatory product safety testing, labeling requirements, and traceability.
  • A prohibition on synthetically produced or chemically altered cannabinoids.

These measures contrast sharply with alternative federal proposals that would cap total THC at 0.4 milligrams per container, a threshold that ONE HEMP argues would effectively eliminate many non‑intoxicating, therapeutic hemp items currently on the market.

Industry Perspective

Kelly Fair, ONE HEMP’s Policy and Regulatory Advisor, emphasized the bill’s pragmatic approach:

“This bill demonstrates that Congress can protect consumers without banning therapeutic hemp products. ONE HEMP has consistently advocated for strong, science‑based regulation, including age restrictions, robust safety standards and enforcement. The Barr‑Craig proposal moves the conversation in that direction.”

John Harloe, JD, PhD, General Counsel for Global Cannabis and a ONE HEMP member, added:

“The choice before lawmakers is not regulation versus no regulation. It’s whether we create a well‑regulated hemp marketplace or effectively prohibit products that consumers rely on and responsible businesses have built. We are encouraged to see a proposed framework that prioritizes safety, accountability, and consumer access.”

Why This Matters

The 2018 Farm Bill legalized hemp with a THC limit of 0.3 % by dry weight, but the rapid emergence of diverse hemp‑derived products has outpaced federal guidance. Agencies such as the FDA and USDA have issued interim statements, yet a comprehensive statutory framework remains absent. By setting a clear, science‑informed THC threshold and implementing age‑gate and safety protocols, the Lawful Hemp Protection Act aims to fill that regulatory gap while preserving the economic viability of the hemp sector—a market projected to exceed $26 billion by 2028 according to industry analysts.
