New York State Broadens Legal Cannabis Sales Through Farmers Markets and Community Events

New York is opening additional venues for legal cannabis sales by allowing licensed microbusinesses and dispensaries to set up at approved farmers markets, pop‑ups and community gatherings. The move, enacted through recent legislation, aims to create more direct‑to‑consumer opportunities for small, local operators while maintaining regulatory safeguards.

What the New Law Allows

Under the updated rules, cannabis can be sold at “Cannabis Showcase Events” hosted within existing markets or special events. These are not open‑air cannabis markets; each sale must occur at a specific, approved location and the business must first obtain:

  • Municipal approval for the event venue.
  • A location‑specific permit from the New York Office of Cannabis Management (OCM).

The OCM stipulates that a single site may host showcase events for no more than 45 days in a calendar year, with each event running up to 14 consecutive days. Sales areas must be restricted to adults 21 and over, and on‑site consumption, free samples or giveaways are prohibited.

Requirements and Safeguards

State officials emphasize that the framework balances market expansion with consumer protection. John Kagia, OCM’s executive director, noted that the change “recognizes the scale of adult cannabis demand in New York” and helps integrate cannabis into community spaces responsibly.

Local market organizers, such as those running the Schenectady Greenmarket, are reviewing how the new policy will affect their layouts. Rose Fera, a board member of the Greenmarket, explained that vendors will need to modify their booths to meet visibility restrictions:

“We’re going to need to do things with our booths so that probably have, you know, walls at least most of the way up so that you can’t see right in and directly see the product, because we’re going to have to follow those, those regs,” she said.

Perspective from a Local Cannabis Microbusiness

Dan and Rose Fera, majority partners in Goldfinch Flora and owners of Leaning Birch Farm, view the change as a natural extension of their existing farm‑stand model. Their son, Nic, co‑operates the business. Rose Fera highlighted the value of face‑to‑face interaction:

“It allows us as a small farm to be able to do like we do with our vegetables and sell directly to our customers,” she said. “Being face‑to‑face with customers allows growers to explain how their products are made and what distinguishes them from others in the regulated market… Talk about our product. Talk about how it’s grown. Give them, you know, all the information we can about its effects, things like that, in a way that even the best educated bartenders just can’t, because we grew it.”

Steps for Operators Interested in Participating

For businesses like Goldfinch Flora, the path forward involves three key actions:

  1. Identify a willing market or event venue that wants to host a cannabis showcase.
  2. Secure municipal approval for the specific location and dates.
  3. Submit a location‑specific permit application to the Office of Cannabis Management.

Once approved, operators can begin sales while adhering to the state’s advertising, packaging and labeling requirements.

Conclusion

New York’s expansion of cannabis sales to farmers markets and community events offers a promising avenue for small operators to reach consumers directly. By coupling increased access with strict local and state oversight, the initiative seeks to nurture a responsible adult‑use market that respects community standards.
