Urgent Senate Action Could Determine Future of the U.S. Hemp Industry

The Senate is poised to vote on an amendment that could overturn the current hemp extension embedded in the Continuing Resolution. Senator Ted Budd’s proposal would strip the extension, effectively triggering a sweeping federal ban on hemp-derived products as early as November 12, 2026. This move has galvanized a broad coalition of industry groups, retailers, public‑health advocates, and agricultural stakeholders who argue that the amendment threatens both consumer access and the livelihoods of thousands of farmers.

Why the Proposed THC Limit Matters

Supporters of the amendment claim that consumers would still be able to purchase non‑intoxicating CBD products. However, a detailed analysis by the U.S. Hemp Roundtable shows that the suggested limit of 0.4 mg THC per container would eliminate many of the most popular CBD items on the market today. According to the 2023 Brightfield Group market report, approximately 62 % of CBD tinctures, capsules, and edibles exceed this threshold when measured per typical serving size, meaning they would become illegal under the new rule.

Beyond product availability, the economic impact could be substantial. The USDA’s Economic Research Service estimates that the U.S. hemp‑derived CBD sector generated roughly $4.6 billion in sales in 2022, supporting over 250,000 jobs across farming, manufacturing, and retail. A sudden ban would disrupt supply chains, depress rural economies, and force many small businesses to close.

Coalition Response and Call to Action

Recognizing the stakes, the U.S. Hemp Roundtable joined 102 other organizations—including major retail chains, convenience‑store associations, restaurant groups, veteran service organizations, patient‑advocacy nets, and agricultural cooperatives—in a letter to Senate leadership dated August 6, 2026. The letter urges lawmakers to preserve the hemp extension while Congress works on a comprehensive, long‑term framework for hemp regulation.

The coalition’s CBD Fact Sheet, available at https://hempsupporter.com/wp-content/uploads/2026/08/CBD-One-Pager.pdf, breaks down the scientific, economic, and policy reasons why the 0.4 mg THC cap is impractical. It cites peer‑reviewed studies showing that most full‑spectrum CBD extracts naturally contain trace THC levels well above this limit when delivered in standard consumer doses.

Now is the moment for constituents to make their voices heard. You can:

  • Email your Senators in under a minute using the pre‑written message: “URGENT Action Needed – Tell Your Senators to Protect the Hemp Extension in the CR | U.S. Hemp Roundtable.”
  • Call the U.S. Capitol Switchboard at (202) 224-3121 and ask to be connected to your Senators’ offices.
  • Read and share the coalition letter: Letter-to-Senate-Leadership-August-6-2026.pdf.

Every email, every call, and every shared document amplifies the message that a responsible, evidence‑based approach to hemp regulation is essential for consumers, patients, farmers, and the broader economy.
