Last week, Representatives Andy Barr (R‑KY) and Angie Craig (D‑MN) introduced the bipartisan Lawful Hemp Protection Act, a federal proposal designed to replace an impending nationwide ban on hemp with a structured regulatory framework. The legislation seeks to preserve access to non‑intoxicating hemp‑derived products, such as CBD, while establishing clear safety and quality standards for manufacturers, retailers, and consumers.

If the current ban were to take effect in November, industry analysts warn that as much as 95 % of the existing hemp market could disappear. This projection stems from data shared by the Hemp Industries Association, which notes that the majority of hemp‑derived CBD products currently sold would fall outside the narrow exemptions allowed under the proposed prohibition. The economic ripple effect would touch farmers who cultivate hemp, processors who extract cannabinoids, and the countless small businesses that rely on these products for revenue.

About the Lawful Hemp Protection Act

The bill does not call for outright prohibition. Instead, it directs the Department of Agriculture to develop national standards for hemp cultivation, processing, labeling, and testing. By creating a federal oversight system, the act aims to address concerns about product consistency, contaminant levels, and accurate potency information—issues that have prompted calls for stricter regulation in recent years.

Lawmakers sponsoring the measure emphasize that regulation, not prohibition, offers a path forward that protects public health while supporting an emerging agricultural sector. Roundtable members are doing their part

Members of the U.S. Hemp Roundtable recently traveled to Washington, D.C., for a congressional fly‑in centered on the future of hemp policy. Over the course of several days, the delegation met with approximately 40 congressional offices to discuss the urgent need for a regulatory solution that safeguards consumers while preserving the industry’s viability.

During those meetings, the Roundtable’s message remained consistent: hemp can and should be regulated, not banned. Participants highlighted both the Lawful Hemp Protection Act and the necessity of extending any deadline for a federal ban long enough to allow Congress to craft a comprehensive, science‑based framework.

The conversations revealed a growing recognition on Capitol Hill that legitimate concerns about product safety and market stability are best addressed through thoughtful regulation rather than prohibition. Advocates plan to continue engaging with lawmakers as negotiations progress, emphasizing that timely action is essential to prevent disruption to farmers, manufacturers, and the millions of Americans who depend on hemp‑derived products for wellness and economic reasons.
