A Travis County judge issued a temporary injunction on March 31, allowing THCA products to stay on shelves while the case proceeds.

State officials, led by Attorney General Ken Paxton, have pushed to eliminate intoxicating hemp for years, even though traditional cannabis remains illegal.

The Texas Hemp Business Council, Hemp Industry Farmers of America and other retailers sued in Travis County District Court on April 20, challenging the new rules that redefined THC measurement.

Regulators’ March 31, 2026 rules targeted smokable hemp flower and effectively prohibited many products by changing how THC is measured.

What’s next with the THCA flower crackdown?

A court will decide whether to permit the proposed statewide ban on THCA flower and related items, according to Houston Public Radio.

The litigation is part of an ongoing debate over whether Texas should legalize, regulate or ban hemp‑derived THC products altogether.

How to get a medical marijuana prescription in Texas

Texas allows low‑THC cannabis through its Compassionate Use Program, which requires a physician registered with the state to enter a prescription into the CURT registry.

Patients may receive oral forms such as oils, tinctures or capsules; smoking is prohibited. Eligible conditions include epilepsy, multiple sclerosis, ALS, autism, terminal cancer and other incurable neurodegenerative diseases.

To qualify, a patient must be a permanent Texas resident, have a qualifying condition, be examined by a registered physician, and receive a prescription if benefits outweigh risks.

Once the prescription is entered, the patient or guardian presents a valid ID, name, birthdate and the last five digits of their Social Security number at a licensed dispensary to obtain the product.
