Virginia Leaders Reach Agreement on Regulated Adult‑Use Cannabis Market

Governor Abigail Spanberger, State Senator Lashrecse Aird, and Delegate Paul Krizek announced a compromise that will launch legal retail cannabis sales in the Commonwealth on July 1, 2027. The agreement, reached through the state budget process, aims to replace the existing illicit market with a safe, tightly regulated system that prioritizes public health, consumer protection, and equitable economic opportunity.

Key Components of the Compromise Legislation

The proposed measure includes several concrete provisions:

  • Establishes a maximum of 350 retail cannabis establishment licenses, a figure comparable to other states with mature adult‑use markets.
  • Raises the personal possession limit from one ounce to two ounces for adults aged 21 and over.
  • Sets the initial state excise tax at 6 % of cannabis sales, increasing to 8 % after July 1, 2029 to fund education and public‑health programs.
  • Allows localities to impose an additional local tax ranging from 1 % to 3.5 % on top of the state rate.
  • Requires the Cannabis Control Authority (CCA) to begin accepting license applications on February 1, 2027, giving regulators time to draft testing, labeling, and safety standards.

Public‑Health and Safety Protections

To address concerns about youth exposure and product safety, the legislation includes:

  • A ban on cartoon‑style advertising and any packaging that mimics animals, fruits, vehicles, or human figures.
  • Mandatory child‑resistant, opaque packaging for all cannabis products.
  • Escalating penalties for retailers who fail to perform proper ID checks, including possible license revocation for repeat violations.
  • A stipulation that retail locations must be at least 1,000 feet from schools, hospitals, playgrounds, and drug‑treatment facilities.
  • Transfer of oversight for intoxicating hemp products from the Virginia Department of Agriculture and Consumer Services to the CCA, closing the so‑called “25:1 hemp loophole” that previously allowed high‑THC hemp items to circulate with minimal regulation.

Equity and Small‑Business Support

Recognizing the disproportionate impact of past cannabis enforcement, the agreement builds in measures to broaden market access:

  • Seventy‑five percent of first‑year license‑fee deposits will be directed into the Cannabis Equity Reinvestment Fund, which provides loans, technical assistance, and workforce development for entrepreneurs from communities historically harmed by drug‑policy enforcement.
  • Authorizes the CCA to issue up to 100 micro‑business licenses by May 1, 2027, allowing operators to run two locations under a single license to promote geographic distribution and prevent market concentration.
  • Maintains a public licensee registry, a tip line for reporting illicit activity, and auditing tools to monitor ownership and financial relationships among licensees.

Revenue Allocation and Long‑Term Goals

Tax proceeds from cannabis sales will be earmarked for:

  • Early childhood care and education programs.
  • K‑12 education funding.
  • Behavioral‑health initiatives focused on substance‑use disorder prevention and treatment.
  • General public‑health programs.
  • The Cannabis Equity Reinvestment Fund, supporting scholarships, reentry services, and community‑based projects aimed at reducing economic disparities.

Governor Spanberger emphasized that the collaborative process — involving legislators, regulators, advocacy groups, and impacted communities — reflects the kind of governing Virginians expect: listening, flexibility, and a focus on practical, enforceable solutions. Senator Aird noted that the agreement moves the state beyond the “failed status quo” where adult possession was legal but no regulated marketplace existed, allowing the illicit market to fill the gap. Delegate Krizek highlighted the importance of ensuring that the benefits of legalization are not limited to large, well‑capitalized operators, but are accessible to small businesses and farmers seeking a fair chance to participate.
